1. Acceptance of Terms

By accessing or using the ProWorx Staffing LLC website (proworxstaffing.com) or submitting any application or form, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

2. About ProWorx Staffing

ProWorx Staffing LLC is an industrial and CDL staffing company providing temporary, temp-to-hire, and direct hire staffing solutions in Louisiana, Texas, and surrounding states. We connect qualified workers with employers in trucking, warehousing, distribution, construction, and related industries.

3. SMS / Text Messaging Terms

By submitting your phone number through any ProWorx Staffing form, application, or website, you expressly consent to receive recurring automated SMS text messages from ProWorx Staffing LLC at the phone number provided. These messages may include:

• Job opportunity notifications and placement updates
• Application status communications
• Scheduling and shift information
• Important staffing announcements
• Responses to your inquiries

Opt-Out: You may opt out of SMS messages at any time by replying STOP to any message. After opting out, you will receive one final confirmation message. No further messages will be sent unless you re-subscribe.

Message & Data Rates: Standard message and data rates may apply depending on your carrier and plan.

Carriers: Supported carriers include but are not limited to AT&T, Verizon, T-Mobile, Sprint, and other major US carriers. Carrier is not liable for delayed or undelivered messages.

We do not share your phone number with third parties for marketing purposes.

4. Applicant Terms

By submitting an application through ProWorx Staffing, you certify that:

• All information provided is true, complete, and accurate
• You authorize ProWorx Staffing LLC to conduct background checks, drug screenings, and employment verifications
• You authorize ProWorx Staffing LLC to contact previous employers as required by FMCSA regulations (49 CFR Part 391.23)
• You understand that falsification of any information is grounds for immediate disqualification or termination
• You are legally authorized to work in the United States

5. Client / Employer Terms

By submitting a job request or entering into a service agreement with ProWorx Staffing LLC, client employers agree to:

• Pay invoices upon receipt. A $35.00 late fee applies after 10 days past due
• A $15.00 processing fee applies to credit card payments
• Bill rates are locked for 12 months from the service agreement date
• Overtime is billed at 1.5x the standard bill rate
• A temp-to-hire conversion fee applies if client hires a ProWorx worker directly within 6 months of placement
• 24-hour notice is required for worker cancellations to avoid minimum 4-hour billing
• Provide a safe working environment compliant with all applicable OSHA and safety regulations

6. Intellectual Property

All content on proworxstaffing.com including text, graphics, logos, and software is the property of ProWorx Staffing LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

7. Limitation of Liability

ProWorx Staffing LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website. Our total liability shall not exceed the amount paid by you for services in the 30 days preceding the claim.

8. Disclaimer of Warranties

Our services and website are provided "as is" without warranties of any kind, express or implied. We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of East Baton Rouge Parish, Louisiana.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of the updated Terms.
